Why Refineries in Residential Areas Don't Make Sense

This is an example of what could have happened here when the Feb 2015 explosion occurred at Torrance Refinery.

As Assemblymember I will urge the Attorney General who has already written a letter to the SCAQMD to take action, to ensure that an injunction banning MHF does occur. Of course the company will go to court to delay the ban. At that point the State, City and refinery can come to the table to work a settlement. I believe the City and State do bear some responsibility for allowing refinery operations and residential neighborhoods to be so close together. 

Part of the negotiation must be to ensure workers are not impacted by a loss of income. There are ways we can work a settlement that is a win-win for all parties. Just as people were afraid when Toyota left Torrance, not people are excited at the opportunities that now provides. Let's not fear change, but rather embrace it and plan for a way ahead that works for all of us.

Estimated cost for bullet train: $77.3 Billion

It's time to halt the High Speed Rail program. The program is far over it's originally estimated cost and behind schedule while also less capable than originally planned. By now lawmakers should know whether it's because of poor program management by the government and contractor, whether the technology is just not ready yet, whether the program was over-sold at the start, or what obstacles were not foreseen.

Corruption in Redondo Beach Goes Unpunished, Again

Tuesday night at the Redondo Beach City Council meeting there was an agenda item for the removal of Marc Mitchell as a RB Planning Commissioner. The cause was for threatening the RB Mayor with what most people would consider a death threat.  In addition to that cause, someone testified about Mr. Mitchell's actions which amount to a case of assault and battery on both the person testifying and another person. One person was poked in the chest by Mr. Mitchell while in the Torrance City Council Chambers following a meeting, and the other was shoved by Mr. Mitchell. Neither incident has been reported to police as of yet. I also testified as a witness to both of the incidents. These both occurred when he was working in his job as a consultant. 

Despite his threats against Mayor Bill Brand, three of the RB Councilmembers still wouldn't set political views aside to remove Marc Mitchell from his Planning Commissioner position. In addition, it should be obvious to anyone that he has a conflict of interest since he is a consultant for the company that supports development of the RB Pier. He should never have been approved to serve as a Planning Commissioner with such an obvious conflict. More detail is provided in the article.

Soaring Costs Threaten Calif High Speed Rail (HSR)

This is a typical problem with government oversight of programs. Elected leaders create a program without adequate analysis. Then because they don't want to be embarrassed by their failure, they continue the program despite evidence that they need to stop and re-assess.

Here, it seems obvious that the technology is not ready for a truly HSR bullet train.  I think the government should focus on assuring that they have the necessary land rights for a future HSR, and stop spending on construction. 

The technology for a HSR is still in development, and for example, Tesla is testing out it's hyper-loop which has great promise. Instead of continuing to construct a system that barely improves on the current AMTRAK system, we should be allowing technology to progress to a point where we have a true HSR bullet train.

SCAQMD Chair Appalled at Asm Muratsuchi's Lack of Leadership

SCAQMD Refinery Hearing (Harbor Gateway, Jan 20,2018)

The Hearing Board and SCAQMD Chairman William Burke heard from Assemblymember Al Muratsuchi, from AQMD staff and took public comment on Proposed Rule 1410 to Ban Modified Hydrogen Fluoride (MHF) at PBF Corp. Refinery in Torrance, and at Valero Refinery in Wilmington.

As Assemblymember I will push for a Ban of MHF at the Torrance Refinery. I testified to the Hearing Board that was my position and provided a written statement for the record as well.

The AQMD and the SoBay community has been forced to deal with a long series of public meetings regarding the potential ban of MHF since a Consent Decree to ban MHF in 1990 was overturned by the courts. The City then failed to follow up, and our State representatives have failed as well. Then, in February 2015 we had an explosion at the Torrance Refinery, and the refinery was allowed to re-start despite the fact that the SCAQMD's own report states that PBF Corp. is unable to adequately contain an MHF spill which could kill thousands of people in the South Bay if it occurs.

In his closing statement, Chairman Burke criticized Assemblymember Muratsuchi because Al has tabled his own bill in committee that would handle this in a much simpler process of getting his own bill, AB1645, through the Assembly Committee on which he sits.

Al made a campaign promise to Ban MHF based on decades long analysis, and now he's torn on what to do, so he gave up responsibility to AQMD. Why does he want to be our representative if he doesn't want to represent us?

A Conservative's Take on Corruption, Lobbyists and the Tax Reform Bill

Although neither "side" tends to admit it, there are actually some great groups that would be labelled as liberal or conservative that provide great insights on the corruption of lobbyist money on our government. Many of these groups are working together to try to reform the process. 

My biggest concern is the corruption of each political party themselves. That's why I think one of our best chances is with groups like Represent.Us that have people across the political spectrum working on state and local ballot initiatives across the US.

Yes, This Will Increase Traffic GridLock

This is an article about a proposed warehouse to be built which will affect Gardena and the Harbor Gateway traffic. Of course the Environment Impact Report (EIR) paid for by the developer says it won't, and that it won't add to pollution in the area. If you care, take the time to send in your comments to your elected officials about this. When elected to represent you as Assemblymember I will fight to make sure that EIR's are not just pieces of paper created to put on a shelf. I'll make sure that my staff and I review them and advocate for your best interest's, not those of the developer.

Winter Wonderland in Harbor City

Thanks to Councilmember Joe Buscaino and his office, City Lights Gateway Foundation, and especially to Sydney Baune (Boardmember on the Harbor City Neighborhood Council) who came up with the concept for this Winter Wonderland, and led the entire project from start to finish. Without her inspiration and leadership, this would not have happened. And of course, thank you to my wife, Lori, and all the other volunteers who worked together to make this such a success.

Health and Safety of Our Beaches Is Not #1 Priority For Elected and Appointed Officials? Yet Again.

This is infuriating! I'm sure all of us have either gotten sick or had family and friends get sick from the poor water quality at these beaches. I recently had a family member suffer from an ear infection after going in the water near the pier, and someone who went with them ended up in the hospital.

It's a shame. We have some of the most famous beaches in the world that people come to, but we aren't ensuring the safety of our own residents or visitors to actually enjoy going into the water.

It's bad enough that this is happening, but when we also know about the massive corruption going on in our South Bay cities, LA City and County and Statewide, this is yet another example of how criminal most of our elected officials are. Kudos to the few that are working hard for us, but are unable to stop the criminals running our government.

As Assemblymember I would work with our Beach Cities and Water Districts to make sure we take common sense measures to ensure water that is emitted to our beaches is properly filtered. I can hardly believe that safety of our residents and visitors is not our #1 priority. As I said, it's criminal that this is not already done.

The Westlands Water District has already voted "No" which will increase the cost for us if our MWD votes for it. Regardless, the project is poorly planned. I think Republicans are right on this one. The gas tax should be repealed. Those who supported the gas tax increase won't tell you that the raise was caused by state misuse of funds by pulling the fees from the truck weighing fees fund from improving roadways over to the general fund.

That’s a typical scenario for all tax increases in California – to bait taxpayers to put money in for a good cause, then switch where the money goes to for cronyism programs. The same thing happened to tax dollars for education from the Lottery. We all expected a big increase in public school spending, but instead we’re one of the lowest in the US.

California Has Too Much Electricity!?

Given that we are already paying Arizona to take our electricity, and electric vehicles sales are greatly increasing -- how much longer do we really need a refinery in Torrance?

Shouldn't we be considering at a statewide level a plan for the shutdown of some of our refineries, and planning to build City or regional energy storage facilities?

Shouldn’t we be planning to have employees be part of the shut-down, and ensure that they have a safety-net as we transition from fossil fuels to renewable energy?
Why are our State and City elected officials not publicly discussing this so that employees, residents and taxpayers are more aware of our options?

It's About WHO Counts the Votes

This is one more reason why I left the Democratic Party. I urge everyone to LEAVE the Democratic and Republican parties. I especially urge anyone that does belong to one of these parties to STOP sending them any money.

I recommend considering the disaster created by our CA Democratic legislators and Governor. Consider the following:

Democrats are complaining about Trump's pushing to dismantle ACA, and have talked about single payer for decades. What are our CA Democrats doing about healthcare in CA? They introduced SB562, then set it aside. Are there any elected Democrats pushing our Democratic legislators to pass SB562?

Democrats are complaining about Trump's policy of deportation. CA Democratic legislators still haven't passed SB54 to protect people from local law enforcement assisting ICE agents. Democrats have a super majority in the Assembly and State Senate, but a majority of our Assemblymembers are allowing local law enforcement to assist Trump, and the CA Sheriffs Dept is assisting Trump.

SB10 would allow for Bail Reform, but CA Democrats haven't passed that either.

Democrats complain about Trump's position on climate change, but CA Democrats passed AB398 which weakens our cap and trade program and takes authority away from the SCAQMD.

Assemblymember Muratsuchi submitted a bill to Ban MHF at refineries. The bill was set aside, and he agrees with his own bill being set aside. Yet he still touts it as a so-called achievement. He is letting the SCAQMD decide. He has washed his hands of the problem.

Isn't all this incredibly hypocritical of our CA Democrats? And have we heard any elected Democrats at the City or Federal level pointing this out? No. Why? Because they really don't care about any of this.

They care about being re-elected. Our Assemblymember Muratsuchi told us at one of his Townhalls that re-election was his main priority. I submitted my Declaration of Intent to run against him the very next week. We can't continue to have people like this representing us. Their #1 care is about the CADem leadership giving them their $1-4 million dollars for their re-election campaigns. Money and fame are their top priorities.

"This bill would prohibit this act from becoming operative until the Secretary of California Health and Human Services gives written notice to the Secretary of the Senate and the Chief Clerk of the Assembly that the Healthy California Trust Fund has the revenues to fund the costs of implementing the act. The California Health and Human Services Agency would be required to publish a copy of the notice on its Internet Web site."

Taxpayers Pay for Sacramento Lobbying

Getting special interest money out of politics is one of my top priorities. Whether it's corporations, unions, Chambers of Commerce, or any other major Political Action Committee, we need to pass legislation which will minimize their influence on our elected officials, and more importantly, on our election campaigns.
Here is an excellent opinion column by Jon Coupal. He provides his insights on the latest report on spending by special interest groups who lobby our state legislators. The usual special interests are on the list, and he focuses on the "far and away" top spender which is the "myriad of local governments". He describes how a portion of our local taxes and fees for services are funneled into lobbying legislators for perks for our local government elected, appointed and union leaders and members. I strongly agree with his closing paragraph:
"The question local taxpayers must decide is whether or not money that could be used to solve local problems should continue to be spent 'wining and dining' the Sacramento politicians. Certainly, the government employee unions think that this investment in Sacramento by local officials is a good deal for them."

State Lands Commission to Hear Testimony on Rancho LPG Safety

Recent explosions, gas leaks, and train derailments focus renewed light on the risks to thousands in San Pedro…and beyond

SAN PEDRO, CA., August 15, 2017, /PRNewswire/ -- At 12 noon on Thursday, August 17, 2017, a panel consisting of homeowners, petroleum consultants, risk experts, environmental attorneys and environmentalists will present their latest findings on the risks to residents in San Pedro as a result of volatile storage tanks located at the Plains All American Pipeline / Rancho LPG (Liquified Petroleum Gas) storage facility.
The news conference is being held immediately before the State Lands Commission (SLC) scheduled hearing at its satellite location in San Pedro Thursday afternoon regarding the safety of the LPG Rancho site. For years, residents and environmentalists have called for the closure of the Plains’All American Pipeline owned, Rancho Liquified Petroleum Gas (LPG) Storage Tanks, citing serious safety risks from earthquakes, train derailments, or potential terrorist threats. Plains has been criminally indicted for the Santa Barbara oil spill.
Attending the news conference will be Gayle McLaughlin, (Past Richmond, CA Mayor & Candidate for Lieutenant Governor), Dr. Carl Southwell,(Risk Policy Institute), Connie Rutter, (Oil Industry Environmental Consultant), Attorney, Anthony Patchett (Retired Los Angeles Prosecutor Environmental Crimes Unit), Jesse Marquez (President of Coalition for a Safe Environment) and Charles Hart (President of San Pedro Peninsula Homeowner’s United).
The Press Conference, at Ports O’Call Waterfront Dining Restaurant 1200 Nagoya Way, San Pedro, CA 90731, will feature a short video highlighting the dangers of the Rancho LPG facility followed by a brief statement on the history of the protracted legal battle by the SPPHU and environmental justice activists which has brought us to this point. Following the video and brief history, the panel will take questions from the press to help the public gain further insight into the rationale for today’s call for the long overdue action to resolve the overwhelming danger from the Rancho LPG Storage Tanks. The press conference will be moderated by Caney Arnold, Candidate for CA State Assembly District 66.
Following the press conference, at 1pm, the State Lands Commission Hearing will begin with the topic of Rancho LPG as the first regular item on the agenda.
The primary site for the SLC Hearing is at Port of San Diego Administration Building, 1st Floor Board Room, 3165 Pacific Highway, San Diego, CA 9210.
